Bashian & Papantoniou P.C. recently filed a lawsuit on behalf of Emma Frank against 54 NOLL LLC, doing business as Foodtown, located at 54 Noll Street, Brooklyn, New York. The case arises from a violation of the Americans with Disabilities Act (ADA) and related state laws.
Our client, Ms. Frank, a 31-year-old individual with PTSD who relies on a service dog for daily activities, was subjected to discrimination while shopping. Despite ADA guidelines, Foodtown employees unlawfully demanded documentation for her service dog and eventually forced her to leave the store. This act not only caused her public humiliation but also deprived her of equal access to a public accommodation.
Through this legal action, we aim to secure injunctive relief and ensure that businesses like Foodtown implement policies that comply with the ADA, providing equitable access to individuals with disabilities.
